Terms and Conditions

This page (together with the documents referred to on it) provides the terms and conditions (“Terms & Conditions”) on which we supply any of the products (“Products”) listed on our website www.pleromapatch.co.za (the “Site”) to you. The Products listed on the Site are supplied directly by Pleroma Patch.

Please read these Terms & Conditions carefully before ordering any Products from the Site. By ordering any of our Products, you agree to be bound by these Terms & Conditions. You can print a copy of these Terms & Conditions by selecting the print option from the "File" menu of your browser. Please note that the use of the Site is subject to the terms contained in the Website Terms of Use, which apply whether or not you order any Products from the Site.

We take privacy seriously. The categories of personal data that we process depend on how you use our services. We use your personal data to provide and improve our services, process your orders, communicate with you, and tailor our offerings to suit your preferences. How the Contract is Formed Between You and Us

1. Placing an Order

   • You may place an order to purchase a Product advertised on the Site by following the onscreen prompts. You will have the opportunity to check and correct any input errors up until the point you submit your order by clicking the "Proceed to Secure Payment" button on the "Payment Details" page. No further changes can be made after this point.

2. Order Acknowledgment

   • After placing an order, you will receive an email acknowledging that we have received your order with a summary. This does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. Acceptance of your order and formation of the contract between us occurs only when we send you a Dispatch Confirmation.

3. Order Acceptance

   • We may choose not to accept your order for any reason and will not be liable in such cases.

4. Order Limitations

   • If a Product is out of stock, discontinued, or there are issues with payment, we may be unable to process your order.

5. Age Restrictions

   • Some Products may be subject to age restrictions. By ordering from the Site, you confirm that you meet any applicable age requirement.

Delivery

1. Delivery Options

   • We will deliver the Products in accordance with the option specified by you when ordering. All Products ordered will be dispatched to the delivery address you specify. Please see our FAQ section for available delivery options.

2. Delivery Costs

   • Any applicable delivery charges will be displayed at checkout. Please review these charges before confirming your order.

Risk and Ownership

1. Transfer of Risk

   • Upon delivery, responsibility for the Products passes to you. We are not liable for any loss, damage, or destruction once the Products are delivered.

2. Transfer of Ownership

   • Ownership of the Products transfers to you once full payment is received, and the Products are delivered.

Price and Payment

1. Pricing

   • The price of any Products will be as listed on the Site, except in cases of error. Prices include VAT where applicable but exclude delivery costs, which are added at checkout.

2. Payment Methods

   • We accept major credit and debit cards. By using a card, you confirm that it is yours. If the card issuer does not authorize payment, we will not accept your order and are not liable for any delay or non-delivery resulting from such refusal.

3. Pricing Errors

   • If a Product’s correct price differs from the Site’s listing, we will, at our discretion, either contact you for instructions or cancel the order and notify you.

Cancellation, Returns, and Refund Policy

1. Cancellation

   • You may cancel your order before the Products are dispatched. To do so, contact us at hello@pleromapatch.co.za. After dispatch, please follow the Returns Procedure on our Site.

2. Returns

   • Products should be returned unused and in their original packaging. You bear the cost and risk of return unless the Products were faulty or damaged on delivery.

3. Refunds

   • Upon receiving returned Products, we will process your refund as soon as possible using your original payment method. We may deduct for loss in value if the Products show excessive handling.

4. Faulty Products

   • If a Product is damaged, faulty, or incorrect upon delivery, you may request a repair, replacement, or refund within 30 days. Beyond this period, you may still be eligible for a repair or replacement under South African law.

Our Liability

1. Our Responsibility

   • We are under a duty to supply Products that conform to the contract. We accept no liability for loss which is not reasonably foreseeable, or for business losses, such as loss of profits or goodwill.

2. Exclusions

   • Nothing in these Terms & Conditions excludes or limits our liability for death or personal injury caused by our negligence or any liability that cannot be excluded by South African law.

Events Outside Our Control

We will not be liable for any failure to perform or delay in performance of any obligations caused by events outside our reasonable control.

General

1. Severability

   • If any of these Terms & Conditions are deemed invalid or unenforceable, that provision will be deleted, and the remaining provisions will continue in full force.

2. Amendments

   • We reserve the right to amend these Terms & Conditions from time to time without prior notice. Any changes will be posted on the Site and will apply immediately to new orders.

3. Legal Jurisdiction

   • These Terms & Conditions are governed by South African law, and any disputes arising out of or in connection with these Terms & Conditions will be dealt with by South African courts.
